A Justiça Federal optou por revogar uma medida imposta recentemente que obrigava a Apple a adotar alterações na App Store do Brasil. O juiz da 14ª Vara Federal Cível, Eduardo Santos da Rocha Penteado, anulou a determinação que partiu do Conselho Administrativo de Defesa Econômica (Cade).
Segundo o magistrado, a medida do Cade é desproporcional e envolve mudanças que “alteram, de forma sensível e estrutural, a organização de negócios” da empresa.
(Imagem: TungCheung/Shutterstock ) Vale recordar que o Cade alega que a loja de aplicativos da Apple possui uma posição dominante no mercado e precisa adotar mudanças para continuar operando em território brasileiro. Um delas é facilitar o uso de métodos alternativos de pagamento de fora da App Store.
Por ora, foi decidido que as medidas precisam de mais discussão antes de eventualmente se tornarem uma imposição. Isso significa que a Apple não será punida de imediato ou terá que promover mudanças na sua loja de apps. O Cade ainda não se manifestou sobre a decisão.
